Brown v. Board of Education, Roe v. Wade Are in Mortal Peril (Brent Budowsky)
The United States Supreme Court is moving to reverse long-cherished American notions of constitutional law.
The divisions that plague American society have invaded the sanctity of the court, with angry dissents and at times personal criticism among justices that illustrate both the passions and dangers of the debate.
These events escalate a pattern of extreme actions that violate cardinal American ideals on matters including torture, the Geneva Convention, attacks on the Bill of Rights, presidential assertions of authority to violate statutes with non-binding statements, secrecy of unprecedented scope, the inability of Congress to perform its historic function of preventing executive abuse, and now a bitterly divided Supreme Court that threatens values long thought to be part of our national consensus.
With the Supreme Court term ending, there is the possibility that one of the justices, or more, soon announces a retirement that will let loose a “war of the worlds” battle that will trigger extraordinary national divisions and political bloodshed.
Even without a Supreme Court retirement, the direction of the court today raises alarming questions about the first principles of freedom, the core values of American law, and basic notions of Americanism that date back to Washington, Jefferson and Madison.
We can no longer believe that Brown v. Board of Education establishes a national consensus on policies that promote integration versus those that tolerate segregation.
We can no longer believe that Roe v. Wade is settled law, based on a societal consensus, that protects a woman’s right to choose. Make no mistake, Roe v. Wade stands in mortal peril of being overturned or dismembered by the current court, and almost certainly, by the next court if another conservative justice is appointed.
The court’s recent attack on McCain-Feingold incorporates the Orwellian style of reasoning that has permeated partisan debates, rather then judicial logic at the center of constitutional law.
In that ruling, the court suggests that if a political interest group saturates the airwaves with highly charged attacks against a public official, in the guise of discussing a divisive political issue, it is not an attempt to influence an election. This is Orwellian, wrong, and guarantees a tidal wave of negative ads by highly financed interest groups in the days preceding the next election.
Today 4 1/2 justices are prepared to thoroughly overturn what was thought to be settled law. This counts Justice Kennedy as the 1/2, and his comments in the recent abortion case are chilling. Justice Kennedy writes that he will prevent adult women from abortions he says are a mistake. This is judicial reasoning?
The angry dissents from Justices Breyer and Ginsburg illustrate the gravity of the risk. The fact they read these in court only dramatizes the magnitude of their outrage and the danger.
Meanwhile:
General Taguba charges a cover-up of the crimes of Abu Ghraib while Guantanamo remains open, despite worldwide outrage and calls for closure from the secretaries of state and defense. George Washington’s opposition to torture is overruled by George Bush’s secret decrees and Dick Cheney’s strange obsession.
Our attorney general leaves footprints near virtually every allegation of wrongdoing from his years as White House counsel to attorney general. He meets with a sedated and very ill John Ashcroft in a bizarre and Nixonian attempt to push through possibly illegal actions.
Alberto Gonzales decimates and destroys the upper echelon of the Justice Department, to the advantage of terrorists, with grave risks to the rule of law.
The president claims unilateral authority to violate the Bill of Rights, operating in secret, seeking to circumvent the courts and Congress. The vice president operates a virtual shadow government, with a virtual shadow CIA, aiming to escape the rule of law, violating cardinal principles of Americanism. The attorney general desperately clutches to office while multiple investigations expand.
The current situation is most alarming because these actions and many more are very public, and the Supreme Court attacks what many thought were settled principles, such as Brown, and makes election rulings destined to let loose partisan forces. Partisan and personal rancor is taking an increasing place on the nation’s highest court.
Justice Scalia is right about one thing in his bizarre attack on the chief justice: It is time to state clearly what is happening. What is happening is a direct and aggressive attack on core constitutional values by multiple sources including the president and the Supreme Court.
Brown v. Board of Education is in mortal peril. Roe v. Wade is in grave danger. The First Amendment, Fourth Amendment and Eighth Amendment, along with others, are under attack. The Geneva Convention is under siege.
Extraordinary presidential powers are claimed. The Supreme Court is drifting into dangerous waters. Congressional courage is collapsing. Terrible misdeeds are justified by a politics of fear and intimidation while the Fourth Estate is otherwise engaged in cheap sensationalism and insider trivia.
There is much to discuss on the Fourth of July.
Liberals, libertarians, strict constructionists of the Constitution and true conservatives should see what is happening clearly, and mobilize to stop it.

I mean with Rush getting his talking points straight from the W.H. how are you going to effect enough interest to get the Liberal base turned up and on fire the way Rush fired up the conservatives on immigration this past week.
The sky is falling and this is becoming such a terrible country I don't understand why you or your liberal bunch want to even stay and support this anarchy through your taxes.

I don't care much about Roe v. Wade but I'd like to see the page in the Constitution where it is directly addressed. And where are any serious threats to segregate America? Serious jursts are coming up with thoughts about the civilian legal system not being a proper tool to fight terrorism, and that's exactly right. If you think this country is regressing to some primitive past, find out the methods used by the US army to defeat the Werwoolf terrorist movement in Germany sixty years ago. The CIA info release the other day shows how much more spying on Americans there was a few years ago.
This attack on our freedom is just a figment of your imagination and the stuff of DailyKos nightmares. Talk radio, the Internet, cable channels of all stripes brought more freedom and involvement than ever before. Indeed the sky is not falling. Vive L'Amerique mon amie!

Constitutional Justices on the Supreme Court are scarce now that Bush has succeeded in replacing them with radical Right Wing Politicians.
You "Conservatives" fell for the Propaganda and demanded those Radical Constitutional Justices be replaced.
The Court is now just what you wanted. One that rules Political and Emotional Vs Constitutional Law.

We are seeing a reversal in judicial activism and it's scaring the liberals that have used it so effectively in the past. It is that only branch of government liberals have been able to get any of their policies implemented. Liberalism (today's version)is rejected everywhere except in the Supreme Court. But now that they don't have a strangle hold on the court, the scenario is frightening. Actually I feel bad for you Brent to be so pesimistic when there is so much to be optimistic about. Like a Supreme Court retirement in the near future.
Roe V Wade needs to be addressed because of the over reaching decision and the fact that technology has changed many people's perspective on when life is viable, and what life looks like within the womb at the very early stages. We need to let the people decide if this 35 year old decision is still a good decision. There is so much new scientific evidence about the viability of life. Anyway, you should feel better that it is getting closer to the end of George Bush's reign and you can pray that you get someone with your optimistic view in the White House. Just a thought…

The Supreme boneheads are in payback mode. They're new mission is to overturn as many "liberal court" rulings as possible befor thekingwithnoclothes gets impeached, commits suicide or both. The idea is to create a legacy of court rulings during his terms to try to bury the incredible record of failure, keeping the conservatives (that have not quit already) from joining the hated Libertines.

Thanks for posting this blog post. The comments here, however demonstrate why the United States of America is in the sorry state it is in today. People are ruled by their ignorance and that's what gets criminal politicians the like of George Bush and Dick Cheney into power who abuse the rights of all Americans be they white, black, asian, latino, man or woman. Bush and others (mostly Republican) run on the very same politics of hate to get themselves elected to office. They throw the "dog bones" of small concessions to their party line, while committing larger crimes than could ever be dreamed of. Of course, sine they are of the right religion and right race, it doesn't matter to people like Melissa. And soon, women rights and minority rights are being threatened, which is "okay" for people like Melissa who believe it will protect her and her family from the "brown" and "black" people. Unfortunately, it won't protect her kids from the white molester or white serial killer who lives next door.
Americans are getting what they deserved as far as a government goes: a dictatorship who is about to dissolve the sovereignty of this nation in favor of an American Union joining Mexico, the U.S. and Canada. I guess if anyone can take comfort from the Supreme Court ruling, it's in that the Court itself will probably be irrelevant in favor of a "higher court" appointed by the American Union whose only interests will be money and cheap labor.
Ha. Your hatred for minorities has brought you the fascist government of today because it allowed the very same people to create a platform to use your idiocy to get themselves elected to office. The current concessions by the Supreme Court are just being used to appease and silence the flock — like Melissa and her ilk.
Women and Minorities are the canaries in the cage. Once their rights are stolen from them, many more will be stolen from Americans. Bush is one of the greatest traitors in history. Once this country is dissolved, people like Melissa will probably use say its all the "black" and brown peoples fault for dissolving the country.

What an inane statement, on the order of: On what page is breathing and sex addressed.
Igor, we were born with certain inalienable rights, and the purpose of government is to protect those rights and not take them away. If the Supreme Court were about to tell you what medical procedures you could or could not have on your own body I'm sure you would be upset.
Please read the preambles to the Declaration of Independence and the US Constitution and learn something.
The inclusion of certain rights in the US Constitution is not intended to be a complete listing of our rights. Our so-called 'constitutional rights' are only a portion of our rights. So, in addition to the above reading assignment, skip to the ninth amendment and read it. You do have a Constitution handy, I assume, since you implied that you've read it (though proof is lacking).

How on earth can we require our officials to behave other than human? There is so much right (legally) and so much wrong (reality) how can you not be frustrated. Lets try this one, make killing illegal period, punishable by imprisonment in the secret prisons whether thats a life sentence or death sentence, I dont know. Now no more war, people are happy. Murderers disappear forever… no prisons or visits or lawyers arguing based on charisma… just like what we do to terrorists! People will stop doing it if they cant get away with it…
And people would feel less stressed.
Of course every elected official would disappear as well, bloodthirsty bastards, but hey it would be law.

A useless Supreme Court, yet another infringement on our rights by the gov't. Add it to the ever-growing list of violations:
They violate the 1st Amendment by opening mail, caging demonstrators and banning books like "America Deceived" from Amazon.
They violate the 2nd Amendment by confiscating guns during Katrina.
They violate the 4th Amendment by conducting warrant-less wiretaps.
They violate the 5th and 6th Amendment by suspending habeas corpus.
They violate the 8th Amendment by torturing.
They violate the entire Constitution by starting 2 illegal wars based on lies and on behalf of a foriegn gov't.
Support Dr. Ron Paul and reverse these trends.

McCain/Feingold is completely unconstitutional. For Christ's sake, even that fascist "decider" stated that he thought that parts of it might be unconsitutional when he signed it. So, it shouldn't have come as a shock to anybody that he did sign it.
Brown v. Board of Education was a judicial outrage to start with, and had nothing to do with the Constitution or constitutional law.
And Roe v. Wade was never "settled law." This just proves how abysmally ignorant the average person in this country is concerning the organic law of the United States. (Notice I used the plural form, and didn't refer to them as a monolithic, centralized entity.)
The Supreme Court can not make law. That is the job of Congress. It's in the Constitution, Article I.
State legislatures are not bound by Supreme Court decisions. It's in the Constitution, Article VI.
Read it. It won't hurt you.

More than three decades ago Roe vs. Wade gave women control of their reproductive lives but nothing in the law changed for men. Women can now have sexual intimacy without sacrificing reproductive choice. Women now have the freedom and security to enjoy lovemaking without the fear of forced procreation. Women now have control of their lives after an unplanned conception. But men are routinely forced to give up control, forced to be financially responsible for choices only women are permitted to make, forced to relinquish reproductive choice as the price of intimacy.
Why can’t these principles of reproductive choice, as articulated in Roe vs. Wade, apply to men? Why can’t I be granted equal protection of the laws which safeguard the right of women to make family planning decisions after sex? Your honor at a time of reproductive freedom for women, fatherhood must be more than a matter of DNA: A man must choose to be a father in the same way that a woman chooses to be a mother in event of an unplanned pregnancy. Why are women not required to share reproductive freedom with men in an event of an unplanned pregnancy. Ultimately, the practical intent and effect of Roe vs. Wade was to permit women to make the following choice: To engage in intimate sexual activity, while, at the same time, choosing not to be a parent, even in the event of a contraceptive failure. No matter what legal analysis is applied, that is the fundamental right created by "Roe." The Supreme Court specifically rejected the argument, as put forth by Wade, that women could make procreative choice by abstaining from sex. Clearly, the Court intended for a woman to have a private, intimate life, without sacrificing the right to make procreative choice.
By its very nature, this is a fundamental right that applies regardless of biology. It cannot survive both as a fundamental right and as a limited right, limited only to people with internal reproductive systems.
When it comes to unwanted, unborn children, men have responsibilities without rights. A man's life can be held hostage to an unplanned pregnancy, but his female partner will have complete control over her reproductive life and future. He can't force motherhood on her but she can certainly force fatherhood on him, even if she has defrauded him about contraception. Only women have the extraordinary freedom to enjoy sexual intimacy free from the fear of forced parenthood. This is an incredible power, taken for granted by most women and denied, by law, to all men.

Sure, that's why we had the unconstitutional Bush v. Gore decision in 2000 that handed the White House to Junior rather than letting the voters of the state of Florida or the Congress decide.

Fact — blacks males are more likely to be arrested, convicted and incarcerated in the US than a white person for the same offense. And, as we've seen from the black men who were released from Illinois' death row (half of the 14 men awaiting execution, incidentally), many black men in the system aren't guilty — they simply have the wrong skin color for juries, some of whom think just like you.
As a lawyer once said, if you enter an American courtroom with dark skin, you're half guilty to before the trial even starts.

OLove, your rights comparison and analysis would make sense if all things were equal in sex, childbirth and parenting. But all things aren't equal. While the male is usually the initiating and controlling agent in the impregnation process the female is the one who bears the duties and risks of pregnancy and childbirth, as well as the primary responsibility, usually, for nurturing and child care. So the female should have a greater voice and more choice in family planning. It's her body, mind and time which are primarily involved while the man can opt to be relatively or completely free of every stage except the first.
